Yesterday, when Florida attorney Michael D. Walsh didn't show up to represent the alleged ringleader in a Fort Lauderdale mortgage fraud trial, a federal judge scheduled a show-cause hearing today to consider whether he should be held in contempt. Today, when the well-known criminal defense attorney didn't appear at the hearing, U.S. District Judge James Cohn issued a contempt order and signed a warrant for Walsh's arrest, reports the Miami Herald. Walsh was to represent Joseph Guaracino in a mortgage fraud trial in which a local real estate attorney, Steven Stoll, who owned a title company is also a defendant. Another defendant lawyer, Stephen Orchard of Boca…

Saying that the government couldn't prove its case, a federal judge in Greenbelt, Md., has dismissed midway through trial an obstruction prosecution against a former in-house lawyer for GlaxoSmithKline. "I conclude on the basis of the record before me that only with a jaundiced eye and with an inference of guilt that's inconsistent with the presumption of innocence could a reasonable jury ever convict this defendant," said U.S. District Judge Roger Titus today as he axed the case against Lauren Stevens before she even presented a defense. It is the first time in his more than seven years on the…

Chicago law firm Much Shelist Denenberg Ament & Rubenstein has authorized a receiver to pursue claims of up to $13 million against its malpractice insurers. The law firm does not admit wrongdoing or liability in the proposed settlement with the receiver for WexTrust Capital, the Virginian-Pilot reports. The receiver had found that Much Shelist did not live up to its professional obligations when it advised WexTrust on securities requirements, the story says. The receiver was appointed to safeguard assets after the Securities and Exchange Commission sued WexTrust Capital, claiming it was operating as a Ponzi scheme that targeted the Orthodox…

The judge presiding over the political corruption trial of former Illinois Gov. Rod Blagojevich told one of his defense lawyers on Monday that he needed to stop asking questions that alluded to inadmissible evidence. U.S. District Judge James Zagel of Chicago told lawyer Aaron Goldstein his questioning was “out of bounds” and elaborated after the jury was dismissed for the day, according to the Chicago Tribune and Reuters. "If you are going to make a defense, make a defense. Don't nibble around the edges with stuff that's inadmissible," Zagel said. "The truth is, if you continue to do this I will sit you down.” Zagel…

U.S. District Judge Royce Lamberth is making no secret of his displeasure over Washington, D.C.'s admission before trial that it had failed to turn over relevant emails in discovery. The city had a plan, though. It vowed to release thousands of additional emails on a rolling basis—but after the April 6 trial of a suit claiming a failure to provide special education programs for preschool students. That was too late for Lamberth, according to The BLT: The Blog of Legal Times. “Imagine a standup comic who delivers the punch-lines of his jokes first, a plane with landing gear that deploys…

A federal judge has tossed a cybersquatting suit filed by Koch Industries against pranksters who issued a fake online press release claiming the company had changed its stance on global warming. U.S. District Judge Dale Kimball of Utah ruled (PDF) against Koch in a decision seen as an important test of First Amendment protections for anonymous speech, Politico reports. The press release, posted on a Web address similar to the one used by Koch Industries, had claimed the conservative-leaning company was cutting off its support for groups opposing global-warming claims. Kimball barred Koch Industries from disclosing the names of the…
